In the summer of 2003 the Regional
District of Nanaimo (RDN) and Cowichan Valley Regional District (CVRD)
announced to the local recycling and solid waste industry their
intention to introduce their draft Waste Stream Licensing Bylaw.
Following an intensive stakeholder consultation and legal review
processes process, a Final
Draft of the Bylaw was released in May 2004.
The Waste Steam Bylaw is a licensing
bylaw for all facilities that manage municipal solid waste and
recyclable materials. It will be used to raise the industry bar by
directing material to legitimate, licensed facilities, while penalizing
generators, haulers and land owners for any improper disposal or
handling of solid waste. The two regions are introducing the bylaw in
parallel in order to create a seamless border for all operators.
The Bylaw was submitted to the regions'
respective Boards and is currently sitting with the provincial Ministry
of Water, Lands and Parks for review. If approved, the Bylaw will be
back to the Boards for adoption, later this year. Once adopted, it is
expected waste facilities will have approximately four to six months to
get their required licenses.
